Brain Quintenz to Resign from Kalshi Board Upon Assuming CFTC Leadership
Brain Quintenz, who is set to become the head of the Commodity Futures Trading Commission (CFTC), has made the decision to step down from his position on Kalshi’s board once he officially assumes his new role.
In a letter addressed to John Einstman, the designated agency ethics official for the CFTC, Quintenz stated, “Upon confirmation, I will resign from my position with KalshiEx.” He also mentioned that he will be relinquishing all shares and unvested stock options he holds in the prediction market platform. Quintenz wrote, “I will forfeit all KalshiEx stock options that are unvested at the time of my resignation. I will divest any vested stock options and stock in KalshiEx as soon as practicable, but not later than 90 days after my confirmation.”
Furthermore, Quintenz declared that he will avoid involvement in any matters related to Kalshi for at least a year after stepping down, stating, “for a period of one year after my resignation, I will not participate personally and substantially in any particular matter involving specific parties in which I know KalshiEx is a party or represents a party”.
Quiet Stance on Sports Betting
Despite calls from state regulators and sports leagues for action, the CFTC has chosen to remain silent on Kalshi’s move into sports betting markets. With Quintenz set to be the only active commissioner out of the five seats upon taking office, there is uncertainty surrounding the regulatory body’s stance on this issue.
With a new leadership in place, the CFTC appears to be leaning towards supporting the expansion of prediction markets. Previously, under the Biden administration, the CFTC had demanded Kalshi to remove its US president market. However, after a legal battle, Kalshi reinstated the market, attracting significant interest from bettors.
This move allowed Americans to legally bet on election outcomes for the first time, and with the CFTC withdrawing its legal challenge, the door has been opened for future election betting. In a notable development, a candidate for California Governor, Kyle Langford, recently placed a bet on himself to win the election.
Expanding Sports Markets
Building on the success of election markets, Kalshi has expanded its offerings to include sports markets this year. While the company had previously limited markets to futures, users can now predict single match outcomes in NBA, NFL, MLB, and NHL. Additionally, they have introduced a variety of March Madness markets in NCAA basketball, resulting in over $400 million in trading volume.
During the Masters last month, Kalshi saw $86 million in trades. Overall, the platform processed approximately $1.97 billion in trading volume in 2024, a significant increase from $183 million in 2023. This growth is expected to continue, especially with the rising popularity of their sports markets.
Currently, sports markets make up more than 75% of all the markets on the platform, causing concern among tribal sportsbooks and state gambling regulators. Despite receiving cease-and-desist letters from seven states, Kalshi has taken legal action in New Jersey, Nevada, and Maryland, with plans to do the same in other states.
So far, judges have ruled in favor of Kalshi, allowing operations to proceed in New Jersey and Nevada. With Quintenz poised to lead the CFTC, it is unlikely that many challenges to Kalshi’s operations will be successful in the near future.
